Need help now? These websites and online forms are not monitored 24/7 and are not emergency services. Call 911 for immediate danger. For 24-hour mental health, emotional, or substance-use crisis support in the United States, call or text 988.
Welcome and Scope
We want our websites to be useful, respectful, and safe. These Terms of Use (“Terms”) govern access to and use of Unica’s public-facing websites, including unicabh.org, the Unica Adoption Services website, and any other public-facing Unica website that links to these Terms (collectively, the “Sites”). They do not govern a patient portal, telehealth session, secure service platform, or other service subject to separate terms, notices, consents, or agreements.
In these Terms, “Unica,” “we,” “us,” and “our” refer to the legal entity Unica. Unica Behavioral Health and Unica Adoption Services are public-facing names used by Unica and are not separate legal entities.
These Terms apply when you access or use the Sites. If you do not agree, please do not use the Sites. Additional terms, notices, consent forms, or program requirements may apply to particular services, events, donations, or secure platforms. If those requirements conflict with these Terms, the more specific requirements will control for that activity.
General Information Only
The Sites provide general information about Unica, its programs, services, events, resources, employment opportunities, and ways to support our work. Website content is not a diagnosis, treatment recommendation, medical or behavioral health advice, legal advice, or a substitute for consultation with an appropriately qualified professional.
Contacting Unica through a Site, email, event registration, or general inquiry does not, by itself, enroll you in a service or establish a professional or service relationship. Any such relationship is established through the applicable intake, eligibility, consent, or service-agreement process, consistent with applicable law.
Emergencies and Crisis Support
The Sites, general email accounts, and online contact forms are not monitored continuously and must not be used for emergencies or urgent safety concerns. If you or someone else is in immediate danger or experiencing a medical emergency, call 911 or go to the nearest emergency room. For 24-hour mental health, emotional, or substance-use crisis support in the United States, call or text 988.
Submitting an online message does not guarantee that it will be received or answered within a particular period unless a specific program page expressly states a response time.
Requests for Services and Online Forms
Please use the form or secure platform identified for the service you are requesting. Do not send medical, behavioral health, substance-use, child-welfare, financial, or other sensitive information through a general contact form or ordinary email. Use only the designated secure method when sensitive information is requested.
You are responsible for providing information that is accurate to the best of your knowledge and for having legal authority or another lawful basis to submit information about another person. A completed form is a request for contact or consideration; it does not guarantee eligibility, enrollment, admission, placement, referral acceptance, appointment availability, or any particular service or outcome.
Where information is collected in connection with health care, behavioral health care, adoption-related services, or another protected service, Unica will handle it in accordance with applicable law and, where applicable, its Notice of Privacy Practices or another service-specific privacy notice. These Terms do not serve as a HIPAA authorization, clinical consent, release of information, or consent to adoption-related services.
Adoption, Foster Care, Guardianship, and Family-Support Information
Information on the Sites about adoption, placement, pregnancy counseling, foster care, guardianship, kinship care, post-adoption support, and family-support programs is general. Individual circumstances, eligibility requirements, legal rights, and available services vary. Website content does not promise a match, placement, adoption, approval, referral, funding, or other outcome.
Nothing on the Sites changes or replaces the requirements of federal, state, or Tribal law; the authority or jurisdiction of any court or Tribal Nation; the terms of a government contract; or the procedures of the New Mexico Children, Youth and Families Department or another responsible agency. Nothing in these Terms limits Tribal sovereignty or jurisdiction, or the rights, cultural connections, and legal protections of Native children and families.
To protect dignity and confidentiality, please use the designated secure process when sharing information about a child, young person, family, pregnancy, adoption plan, placement, investigation, or case. Do not submit another person’s sensitive information unless you have legal authority or another lawful basis to do so.
Children and Young People
People of all ages may use the Sites to find information. Unless a form specifically says it may be completed by a young person, general website forms should be completed by an adult. Children under 13 should not send personal information through a general form. If you are a young person seeking help, call Unica’s main line at 505-271-0329 so we can help you understand your options. You may also ask a trusted adult for help if that feels safe. Service-specific rules about consent, confidentiality, and adult involvement are governed by applicable law and Unica’s service procedures; these Terms do not change those rights or requirements. Emergency and crisis resources remain available regardless of age.
Events, Trainings, and Virtual Meetings
Event registration may require contact information and may be subject to additional notices or participation expectations. Registration does not guarantee admission when capacity, eligibility, safety, or program requirements apply. Unica may change, cancel, postpone, or limit participation in an event when reasonably necessary.
Do not share virtual meeting links, passcodes, another participant’s name, or information shared during support groups or other meetings intended to be private without authorization. Participants may not record audio, video, screenshots, chat messages, or other meeting content unless Unica has provided advance written permission and all required consents have been obtained.
Participants are expected to respect the privacy and dignity of others. Unica sets participation expectations intended to support a respectful environment but cannot guarantee that another participant will keep information confidential. Unless a program expressly identifies an activity as clinical care, an educational event or peer support group is not psychotherapy, medical treatment, legal advice, or emergency support.
Donations and Other Transactions
Donations and certain transactions may be processed through third-party platforms. Those providers may apply their own terms and privacy practices. Unica may decline or return a transaction when reasonably necessary, including because of an error, suspected fraud, legal requirement, or donor restriction Unica cannot honor. Unica will not change a donor restriction without appropriate donor authorization. Donors should consult their own tax advisers regarding deductibility or other tax consequences.
Privacy and Confidentiality
Our Website Privacy Policy explains how information collected through the Sites is used and shared. Our Notice of Privacy Practices explains how protected health information may be used or disclosed and describes applicable individual rights. These Terms do not replace either notice and do not authorize any use or disclosure that otherwise requires consent or authorization.
Please remember that no website, email system, or internet transmission can be guaranteed to be completely secure. Use the designated secure forms for sensitive information and contact Unica if you are unsure which communication method is appropriate.
Third-Party Websites and Services
The Sites may link to services operated by others, including referral, registration, donation, payment, mapping, video, social media, employment, and document-viewing services. When you use those services, their terms and privacy practices may apply. Unica does not control unaffiliated websites. This section does not change any responsibility Unica has under applicable law for vendors it selects or uses.
Ownership and Permitted Use
Unless otherwise indicated, the Sites and their text, design, graphics, logos, photographs, videos, downloads, and other content are owned by or licensed to Unica and are protected by applicable intellectual-property laws. You may view and use the Sites for lawful, personal, educational, and noncommercial purposes.
Materials specifically identified as partner toolkits, shareable resources, or approved promotional materials may be downloaded and distributed for the stated purpose, provided they are not materially altered, presented misleadingly, sold, or used to imply an unauthorized endorsement or partnership. All other copying, republication, modification, commercial use, or use of Unica’s names and logos requires prior written permission.
Prohibited Uses
Nothing in these Terms prohibits lawful complaints, reviews, reports to regulators or law enforcement, requests for records, or other legally protected activity.
You may not use the Sites to:
- Violate any applicable law or the rights, privacy, dignity, or safety of another person;
- Submit false, fraudulent, threatening, harassing, discriminatory, exploitative, defamatory, or unlawful material;
- Impersonate another person or misrepresent your identity, authority, affiliation, eligibility, or relationship with Unica;
- Collect, expose, or misuse information about clients, children, young people, families, donors, employees, event participants, or other website users;
- Share restricted virtual-meeting credentials or attempt to enter a meeting, program, account, or service without authorization;
- Upload malware, interfere with Site operations, bypass security controls, probe for vulnerabilities, or gain unauthorized access to systems or information; or
- Use automated tools to scrape, copy, overload, or systematically extract Site content or data, except for ordinary search-engine indexing, use of assistive technology, or activity expressly authorized by Unica.
Unica may restrict or end access to the Sites when it reasonably believes these Terms have been violated or when necessary to protect people, systems, services, or legal rights.
Messages, Feedback, and Other Submissions
Do not submit material that you do not have the right or another lawful basis to provide. Unica may use information you submit as reasonably necessary to respond to your request, administer the relevant activity, protect safety and security, comply with law, and carry out the purposes described in the applicable privacy notice. Submitting a story, photograph, testimonial, or other material does not by itself authorize Unica to publish it; separate permission will be obtained when required.
Accuracy, Availability, and Changes to the Sites
Unica works to keep Site information useful and current, but information may occasionally be incomplete, unavailable, or out of date. Program details, eligibility criteria, locations, hours, staffing, event schedules, funding, and services may change. Please contact Unica or the applicable program to confirm information that is important to a decision or time-sensitive need.
Unica may update, correct, suspend, or discontinue any part of the Sites without notice when reasonably necessary. We do not guarantee that the Sites will always be available, uninterrupted, or error-free.
Disclaimer of Warranties
To the fullest extent permitted by applicable law, Unica makes no warranties regarding the completeness, accuracy, or continuous availability of general Site content. This disclaimer does not limit any warranty or right that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by applicable law, Unica is not responsible for losses resulting solely from reliance on general website information, temporary Site unavailability, or independent third-party content outside Unica’s control. These limitations apply only to use of the Sites. Nothing in these Terms limits duties, rights, or liability that cannot lawfully be limited, including responsibilities arising from professional services or applicable privacy, confidentiality, child-welfare, or consumer-protection laws.
Governing Law and Severability
To the extent a choice of law is permitted, these Terms are governed by New Mexico law. Applicable federal and Tribal law also continues to apply. Nothing in these Terms limits Tribal sovereignty or jurisdiction, or restricts a right or remedy that cannot lawfully be restricted.
If any provision of these Terms is found unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect. A failure by Unica to enforce a provision is not a waiver of that provision or any other right.
Changes to These Terms
Unica may update these Terms as its Sites, services, or legal obligations change. The revised Terms will be posted with an updated date. Material changes will apply prospectively to use after the revised Terms are posted, except where applicable law requires different notice or consent.
